Pioneer Boulangerie Mixed-Use Development
HLKK land use attorneys represented the developer of two mixed-use projects on Main Street in Santa Monica.  133 housing units, together with ground floor retail and subterranean parking are being developed on these key sites not far from the Civic Center.  Land use issues included the Permit Streamlining Act, CEQA, an EIR, inclusionary housing, architectural review, coastal development permits, a vesting tentative map, historic resources and land use litigation. http://www.ArchstoneSantaMonicaonMainStreet.com

Le Merigot HotelLe Merigot Hotel
This luxury beachfront hotel is located on a Santa Monica site first pursued in the late 1980s by developer Rob Maguire. HLKK land use attorneys assisted Maguire Thomas Partners in obtaining the original City and Coastal Commission entitlements and helped to maintain those entitlements for 10 years until the market again favored hotel construction. Involvement with the project after the site was sold to its current owner. HLKK's attorneys assisted with a variety of zoning and building issues, including successfully litigating a traffic mitigation issue against the City and working with the City and the State Department of Alcoholic Beverage Control in connection with the hotel's alcoholic beverage license. http://www.lemerigothotel.com

Oxnard Downtown Theatre Project
HLKK assisted the developer of the mixed-use Oxnard Downtown Theatre Project prepare comprehensive CC&Rs governing the maintenance and operation of the project. HLKK also assisted the developer in negotiating the multiplex theatre lease and other tenant leases including the leases for Starbucks and Subway. In addition, HLKK assisted in the refinancing of the project.

Thousand Oaks/Newbury Park Mixed-Use Project
HLKK assisted the developer of a retail/hotel development with regard to subdivision issues, sales of two parcels for hotel developments and negotiating a master development agreement.

Simi Valley Residential/Retail Development
HLKK assisted the developer of a mixed-use residential and retail project across from the Simi Valley City Hall. HLKK's work included assisting in the acquisition of the property from a school district, subdivision work, sale of parcels to residential housing developers, preparing master CC&Rs, negotiating an agreement for development of the underlying infrastructure, and negotiating a freeway off-ramp improvement agreement. HLKK also assisted in the refinance of the project.

The ArboretumThe Arboretum
Beginning in the mid-1980s, HLKK's land use attorneys worked with owners of this 12-acre site in eastern Santa Monica to negotiate a development agreement with the City for a one-million-square-foot, mixed-use commercial project planned to consist primarily of a hotel and office space. Years later, and on behalf of a new owner, a major amendment to the original development agreement was negotiated to convert the site to a combination of office, retail and housing due to changing market conditions.

Champagne TowersChampagne Towers
Following the 1994 Northridge earthquake, HLKK's attorneys assisted the owners of this nine-story, 120-unit luxury apartment building in developing and implementing a strategy for the project's redevelopment in the face of local rent control laws and the site's downzoning to a three-story maximum height limit. HLKK's attorneys were able to obtain permission to maintain the nine-story structure and to charge significantly higher rents, including market rents for many units.  http://www.1221oceanavenue.com/contact/contact.asp

Cathedral City Entertainment CenterCathedral City Entertainment Center
HLKK's attorneys represented Palm Canyon Partners in the negotiation of a disposition and development agreement and related documents with the Cathedral City Redevelopment Agency for acquisition of vacant land and construction of a multiplex theater and parking structure complex in the heart of the City's new downtown area. HLKK's attorneys also assisted in negotiating the construction loan for the theater project and in obtaining options on several adjacent parcels designated for hotel and retail development.  The attorneys further presented Palm Canyon Partners and a joint venture partner while negotiating an Owner Participation Agreement to develop multi-family housing adjacent to the multiplex theater.

St. John's HospitalSaint John's Hospital and Health Center
HLKK's land use attorneys represented this leading health care organization in drafting and negotiating a development agreement for its new Santa Monica Health Center replacing the buildings severely damaged in the 1994 Northridge earthquake. The $275 million phase-one replacement hospital implements a new vision for the community focusing on a combination of wellness and fitness as well as standard medical care. The new facility needed approvals from a variety of agencies that regulate zoning standards, development permitting, historic preservation, environmental impacts and health services. In addition to applying legal skills, HLKK's attorneys used their local expertise to assist in building community consensus around the project.  http://www.stjohns.org

The developers of this luxury condominium project retained HLKK's land use attorneys to negotiate a settlement of litigation challenging the City of Santa Monica's denial of construction permits. HLKK's attorneys were successful in enabling the project to proceed in accordance with the superseded development standards that had been in effect when the project applications were filed even though those standards had subsequently been changed.

HLKK's land use attorneys represented Maguire Partners in securing a Development Agreement and related permits from the City of Santa Monica for this premier office project and assisted in obtaining a coastal permit from the California Coastal Commission.

Single family homeownersSingle family homeowners
Various homeowners have turned to HLKK to represent them in redressing grievances against the City, such as downzoning which occurs in the middle of construction, attempted retroactive application of new City policies, and obtaining approvals to demolish buildings that cannot be upgraded to meet current codes.
